{"id":355,"date":"2020-03-21T15:49:15","date_gmt":"2020-03-21T15:49:15","guid":{"rendered":"https:\/\/www.b2bcfo.com\/jim-schuck\/?p=355"},"modified":"2023-04-18T21:18:27","modified_gmt":"2023-04-18T21:18:27","slug":"your-company-and-affordable-care-act","status":"publish","type":"post","link":"https:\/\/www.b2bcfo.com\/jim-schuck\/compliance-with-the-aca\/","title":{"rendered":"Is your company in compliance with the Affordable Care Act?"},"content":{"rendered":"<p>Time is running out on companies that make payments to employees in lieu of providing a healthcare plan.<\/p>\n<p>From the <a href=\"https:\/\/irs.gov\" target=\"_blank\" rel=\"noopener noreferrer\">irs.gov<\/a> website.<\/p>\n<h1>Employer Health Care Arrangements<\/h1>\n<p><strong>Q1.\u00a0 What are the consequences to the employer if the employer does not establish a health insurance plan for its own employees, but reimburses those employees for premiums they pay for health insurance (either through a qualified health plan in the Marketplace or outside the Marketplace)?<\/strong><\/p>\n<p>Under\u00a0<a href=\"https:\/\/b2bp\/wp-content\/uploads\/sites\/142\/2020\/03\/n-13-54.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">IRS Notice 2013-54<\/a>, such arrangements are described as employer payment plans.\u00a0An employer payment plan, as the term is used in this notice, generally does not include an arrangement under which an employee may have an after-tax amount applied toward health coverage or take that amount in cash compensation. As explained in Notice 2013-54, these employer payment plans are considered to be group health plans subject to the market reforms, including the prohibition on annual limits for essential health benefits and the requirement to provide certain preventive care without cost sharing.\u00a0 Notice 2013-54 clarifies that such arrangements cannot be integrated with individual policies to satisfy the market reforms.\u00a0 Consequently, such an arrangement fails to satisfy the market reforms and may be subject to a $100\/day excise tax per applicable employee (which is $36,500 per year, per employee) under section 4980D of the Internal Revenue Code.<\/p>\n<p>See all FAQ&#8217;s on the Affordable Care Act at:<\/p>\n<p><a href=\"https:\/\/www.irs.gov\/affordable-care-act\/employer-health-care-arrangements\" target=\"_blank\" rel=\"noopener noreferrer\">http:\/\/www.irs.gov\/Affordable-Care-Act\/Employer-Health-Care-Arrangements<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Time is running out on companies that make payments to employees in lieu of providing a healthcare plan.
